1.1  About Us

Raw Recovery & Wellness LLC ("RAW," "we," "us," or "the Company") is a limited liability company organized under the laws of the State of California. Our principal place of business is located at 2260 Park Avenue, Laguna Beach, CA 92615. We operate the website located at www.rawrecoveryandwellness.com (the "Site"), as well as associated digital platforms, programs, and services described herein (collectively, the "Services").

1.2  Acceptance of Terms

By accessing or using the Site or any of our Services — whether by creating an account, enrolling in a program, making a purchase, or simply browsing — you ("User," "you," or "Member") agree to be legally bound by these Terms and Conditions ("Terms"), our Privacy Policy, and any supplemental terms applicable to specific programs or features. If you do not agree to all of these Terms, you must not access or use the Services.

1.3  Changes to These Terms

We reserve the right to modify these Terms at any time. When we do, we will post the revised Terms on the Site and update the "Last Updated" date above. For material changes, we will provide notice via the email address associated with your account at least fourteen (14) days before the changes take effect. Your continued use of the Services after the effective date of any changes constitutes your acceptance of the revised Terms.

1.4  Eligibility

To access or use the Services, you must:

• Be at least eighteen (18) years of age;
• Be legally capable of entering into a binding contract under applicable law;
• Not be a person barred from receiving services under the laws of the United States or any other applicable jurisdiction;
• Complete and meet all enrollment requirements for your selected program, including any program-specific eligibility criteria set forth in these Terms.

2.1  Not a Therapy or Mental Health Service

The Services provided by Raw Recovery & Wellness LLC are coaching and wellness education services only. RAW IS NOT A LICENSED MENTAL HEALTH PRACTICE, MEDICAL PRACTICE, OR CLINICAL TREATMENT PROGRAM.

Our coaches, facilitators, and program staff are not licensed psychologists, licensed clinical social workers, licensed marriage and family therapists, licensed professional counselors, psychiatrists, physicians, or any other type of licensed mental health or medical professional in their capacity with RAW — regardless of any independent professional licensure they may hold outside of their role with us.

Our Services, including the Men of Fortitude™ program and all related content, are not intended to diagnose, treat, cure, or prevent any mental health condition, substance use disorder, medical condition, or any other health condition. They are not a substitute for professional mental health treatment, psychiatric care, medical care, crisis intervention, or addiction treatment.

If you are experiencing a mental health emergency, are in crisis, or are in immediate danger of harming yourself or others, please call 911, go to your nearest emergency room, or contact the 988 Suicide and Crisis Lifeline by calling or texting 988.

2.2  Coaches as Independent Contractors

All coaches, facilitators, and group leaders providing services within the RAW platform are independent contractors and are not employees, agents, or representatives of Raw Recovery & Wellness LLC. RAW does not control the specific methods or manner of coaching delivery beyond program guidelines. RAW is not responsible for the independent acts, omissions, advice, statements, or conduct of its coaches beyond their participation in RAW-facilitated sessions.

2.3  No Guarantee of Results

The outcomes of coaching and wellness programs vary significantly by individual. RAW makes no guarantee, express or implied, that participation in any program will produce specific results including, but not limited to, sobriety, improved mental health, professional performance improvements, or relational changes.

2.4  Early Recovery Suitability

The Men of Fortitude™ program and related Services are not designed for individuals in early sobriety or early recovery (defined as fewer than twelve (12) consecutive months of sobriety from substances at the time of enrollment). By enrolling, you represent that you do not meet this exclusion criteria, or that you have been explicitly approved for participation in writing by RAW's enrollment team.

3.1  Account Creation

To access certain Services, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for all activity that occurs under your account.

3.2  Account Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at melissa@emotionalfortitude.com if you suspect unauthorized use of your account. RAW is not liable for any loss or damage arising from your failure to maintain account security.

3.3  One Account Per Person

Each account is for a single individual user. You may not share your account, credentials, or program access with any other person. Program participation is personal and non-transferable.

4.1  Use of Third-Party Services

The Services may be delivered through or in connection with third-party platforms including Zoom, Slack, and Stripe (collectively, "Third-Party Platforms"). Your use of these platforms is subject to their respective terms of service and privacy policies, which are independent of these Terms.

4.2  Session Recording

Certain sessions may be recorded for quality assurance, coaching supervision, and program improvement purposes. In compliance with California Penal Code Section 632 (an all-party consent state), by enrolling and participating in sessions, you acknowledge and consent to the recording of sessions in which you participate. This consent is confirmed through the Zoom platform prior to any recorded session. If you do not consent to recording, you must notify your coach immediately and must not participate in any designated recorded session.

5.1  Payment Processing

All payments are processed through Stripe. By submitting your payment information, you authorize RAW to charge your payment method on file for all applicable fees and renewals. RAW does not store your complete credit card information on its servers.

5.2  Refund Policy — Initial 12-Week Program

You may request a full refund within fourteen (14) calendar days of your initial payment, provided you have not attended more than one (1) live group session. After this window, all program fees are non-refundable. To request a refund, email melissa@emotionalfortitude.com within the refund period. No partial refunds are issued for unused weeks or partial program completion after the refund window expires.

6.1  The Program

The Men of Fortitude™ program is a structured twelve (12) week coaching and nervous system development program delivered in small groups ("Fortitude Circles") of up to ten (10) participants, facilitated by independent contractor coaches via weekly live virtual sessions, asynchronous curriculum, coach access via Slack, and two (2) virtual weekend workshops. Men of Fortitude™ is a trademark of Raw Recovery & Wellness LLC. All rights reserved.

6.2  Monthly Continuation Subscription — Automatic Renewal

6.3  How to Cancel

You may cancel your Monthly Subscription at any time, without penalty, by:

• Emailing melissa@emotionalfortitude.com or rawrecoveryllc@gmail.com with your name, account email, and a written cancellation request;
• Contacting your coach via Slack and requesting written confirmation be forwarded to RAW administration;
• Using any cancellation mechanism made available on the Site.

Cancellations received before the next billing date take effect at month end. No refunds are issued for the current billing period. RAW will confirm cancellation in writing within three (3) business days.

6.4  Price Changes

RAW reserves the right to change the Monthly Subscription price with at least thirty (30) days' advance written notice. Continued use after the new price takes effect constitutes acceptance of the new pricing.

6.5  Conduct Standards

By enrolling, you agree to:

• Treat all participants, coaches, and staff with dignity and respect;
• Maintain absolute confidentiality of all other participants' disclosures, stories, and identities;
• Not record, reproduce, or distribute any session content or program materials without written authorization from RAW;
• Refrain from giving unsolicited advice or presenting yourself as a substitute for professional services within the program;
• Notify your coach or RAW immediately if you believe another participant poses a risk to themselves or others.

Violation of these standards may result in immediate removal from the program without refund, at RAW's sole discretion.

7.1  RAW's Intellectual Property

All content provided through the Services — including program materials, curriculum, videos, audio recordings, written guides, frameworks, assessment tools, and the Men of Fortitude™ trademark — is the proprietary intellectual property of Raw Recovery & Wellness LLC or its licensors, protected by U.S. and international copyright, trademark, and intellectual property laws.

7.2  License to Members

Upon enrollment, RAW grants you a limited, non-exclusive, non-transferable, revocable license to access and use program materials solely for your personal, non-commercial participation in the program during your enrollment. This does not include the right to copy, distribute, modify, or create derivative works from any program materials.

7.3  Prohibited Uses

• Copying, reproducing, distributing, or selling any RAW program materials;
• Using RAW frameworks or curriculum to develop competing products or services;
• Sharing account access with third parties;
• Recording any session without prior written authorization from RAW and the express consent of all participants.

Your privacy is governed by our Privacy Policy, available at www.rawrecoveryandwellness.com/privacy, which is incorporated into these Terms by reference. By using the Services, you consent to the practices described in our Privacy Policy. Given the sensitive nature of information shared through our programs, RAW takes privacy seriously. 9.1  Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2  Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RAW'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES PAID BY YOU TO RAW IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).

9.3  Assumption of Risk

You acknowledge that participation in coaching and group work involves inherent emotional and psychological engagement. You voluntarily assume all risk associated with your participation. RAW strongly recommends that participants maintain a concurrent relationship with a licensed mental health professional, particularly those with significant trauma history, clinical diagnoses, or active recovery concerns.

9.4  Indemnification

You agree to defend, indemnify, and hold harmless Raw Recovery & Wellness LLC and its members, managers, officers, coaches, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses arising out of or related to your use of the Services, your violation of these Terms, or your violation of any applicable law.

10.1  Informal Resolution First

Before initiating any formal dispute resolution, you agree to contact RAW at melissa@emotionalfortitude.com and make a good faith effort to resolve the dispute informally. RAW will respond within fourteen (14) business days.

10.2  Binding Arbitration

If a dispute cannot be resolved informally within thirty (30) days, you and RAW agree that all disputes shall be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures, conducted in Los Angeles County, California (or by videoconference). The Federal Arbitration Act governs this provision.

10.3  Class Action Waiver

YOU AND RAW AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, REPRESENTATIVE, OR COLLECTIVE ACTION.

10.4  Governing Law

These Terms are governed by the laws of the State of California. For claims not subject to arbitration, you consent to the exclusive jurisdiction of state and federal courts in Los Angeles County, California.

11.1  Entire Agreement

These Terms, together with our Privacy Policy and any supplemental program-specific terms, constitute the entire agreement between you and RAW with respect to the Services.

11.2  Severability

If any provision of these Terms is found invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will continue in full force and effect.

11.3  Force Majeure

RAW shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including acts of God, natural disasters, pandemic, or failure of third-party services.
